Hutchinson Settlement

On June 2, 2008, a landmark settlement was reached that enables individuals with brain injuries to move out of nursing facilities and into the community.
After living in a nursing home for more than a decade, Cathy Hutchinson, lead plaintiff in the Hutchinson v. Patrick Settlement, moved into a home with four other women who also benefited from the Hutchinson v. Patrick Settlement.

Moving Home: The Next Step in a Landmark Settlement
A video has been produced documenting the landmark settlement in Massachusetts that paved the way for brain injury survivors to move out of nursing homes and into the community. It follows 29-year-old survivor Raymond Gould as he moves from the confines of a nursing home to a life of greater freedom and independence.

If you live in a nursing home or chronic or rehabilitation hospital and have a brain injury, you may want to apply for the ABI Waiver. This waiver provides an opportunity to live in the community with ongoing services and resources.
WAIVERS ARE OPEN TO ELIGIBLE INDIVIDUALS WITH BOTH ABI AND TBI.

The ABI Waiver with Residential Habilitation (ABI-RH) is for Medicaid-eligible persons with ABI who are patients in a nursing home or chronic or rehabilitation hospital and need supervision and staffing 24 hours a day, seven days a week and who want to move to a provider-operated residence in the community.

The ABI Waiver with No Residential Habilitation (ABI-N) is for Medicaid-eligible persons with ABI who are patients in a nursing home or chronic or rehabilitation hospital and who want to move to their own home or apartment or to the home of someone else.
